    Highlights and Mitigation Requirements
  • The ROD approves Alternative A which at full build out calls for 20,000 sq. ft. of tribal government offices, 16 elder housing units, a 12,000 sq. ft. Cultural center and a 134,150 sq. ft. casino-resort complex with a 250 room hotel.
  • The ROD approves the Tribe's request for a reservation proclamation.
  • The ROD determines that the land will be eligible for gaming.
  • The ROD finds that Cowlitz meets the "under federal jurisdiction in 1934" test of the Carcieri decision.
  • The ROD finds that the Cowlitz has a strong historical connection to the Lewis River area and rejects opponent's arguments to the contrary.
  • The mitigation requirements in the Tribe's Environment Public Health and Safety (EPHS) Ordinance were adopted.
  • The Rod finds that the EPHS Ordinance and its enforcement mechanisms are sufficient to take the place of a formal MOU.
  • The Tribe will be required to comply with the 2004 County Ordinances as provided in the (now rescinded) MOU and in the Tribes EPHS Ordinance. Compliance with the current County Ordinances will not be required.
  • The Tribe will not be required to provide mitigation to the City of La Center for lost tax revenue.
  • The ROD assumes an on-site sewer system, but also approves sewer service from La Center.
  • Section 6.0 set out dozens of additional mitigation actions that will be required of the Tribe.
